This course examines current civil and canonical law of marriage, including definitions of marriage, capacity to marry, 'de facto' marriage', civil recognition of 'same-sex' relationships, canonical declarations of nullity and dissolutions of marriage, and civil divorce.
It also treats of law regarding the family, including issues of procreation, parental authority, custody and guardianship, and children's rights. Attention is given to legislation such as the Family Law Act in Australia and the Code of Canon Law in the universal Church, as well as decisions of courts and tribunals interpreting those laws and the operation of those bodies, especially diocesan marriage tribunals. The underlying philosophy of law and of marriage and the family is also examined.
